Hello and welcome to Leadferno. Our website and all applications, dashboards or platforms (individually and collectively, the “Site”), are owned and operated by Leadferno, LLC. Leadferno is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of Leadferno constitutes your agreement to all such Terms. Please read these terms carefully and keep a copy of them for your reference.

If you are acting on behalf of your employer or your company, the term “Client” or “You” means that entity, and you are binding that entity to this Agreement. You represent and warrant that you have the legal power and authority to enter into the Agreement.

Privacy

Your use of Leadferno is subject to Leadferno’s Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

Electronic Communications

By using Leadferno, you consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy and legal requirement that such communications be in writing.

Your Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Leadferno is not responsible for third party access to your account that results from theft or misappropriation of your account. Leadferno reserves the right to refuse or cancel service, terminate accounts, charge for services provided, or remove or edit content in our sole discretion.

Acceptance of terms

The Services are offered subject to your acceptance of the terms and conditions contained herein and all other operating rules, policies and procedures that may be published from time to time by Leadferno related to the Services, which shall be incorporated herein by reference. By accessing, registering for and/or using the Services in any manner you agree to the Terms. If you do not agree to the Terms, do not use the Services.

Changes

We may make changes to the Terms and/or our other operating rules, policies and/or procedures from time to time, in our sole and absolute discretion. We will notify you of any changes to the Terms by posting the updated Terms on Leadferno’s website and/or the platform, and we will revise the “Updated” date above. Any changes to our operating rules, policies and/or procedures shall be incorporated herein. It is your responsibility to review the Terms frequently and to remain informed of any changes to them. We may also provide you with additional forms of notice of modifications and/or updates as appropriate under the circumstances including but not limited to sending you an email informing you of the changes and/or by prominently posting notice of the changes on Leadferno’s website and/or platform. If you do not agree with the changes and/or modifications, you shall not use the Services after the effective date of the changes. The then-current version of the Terms will supersede all earlier versions. You agree that your continued use of the Services after such changes have been published will constitute your acceptance of such revised Terms and operating rules, policies and/or procedures (as applicable).

License to use our services

Ownership and Rights to Access and/or Use the Services. By using the Services and subject to your compliance with the Terms: (i) Leadferno grants to you a limited, personal, non-exclusive, non-transferable, revocable right to use and/or access the Services; and (ii) you agree not to reproduce, distribute, create derivative works from, publicly display, publicly perform, license, sell and/or re-sell any content, software, products and/or services obtained from and/or through the Services without the express prior written permission of Leadferno. Neither the Terms nor your access to and/or use of the Services transfers to you and/or any third party any rights, title and/or interest in any intellectual property rights related to the Services.

Reservation of Rights. Our Services are protected by applicable intellectual property laws. Leadferno reserves all right, title and interest in and to the Services, including without limitation all related worldwide intellectual property rights. No rights are granted to you hereunder other than as expressly set forth herein.

Availability of Content. We do not guarantee that any content will be made available on the Services. We reserve the right to, but do not have any obligation to, (i) remove, edit and/or modify any content in our sole discretion, at any time, without notice to you and for any reason (including, but not limited to, upon receipt of claims and/or allegations from third parties and/or authorities relating to such content and/or if we are concerned that you may have violated the Terms), and/or for no reason at all and (ii) remove or block any content from the Services.
